Terms & Conditions
1. No liability is accepted for losses arising from omissions, failure to publish, publication of wrong "copy", poor positioning, typographical, or other errors oc
curring in material supplied by client or created to client specification and signed off. In case of such losses, the advertiser is not exempt from any contractual obligations.
2. Telephonic instructions must, in all cases, be confirmed in writing.
3. The advertiser will furnish material for processing before the closing date for material.
4. No cancellation of advertisements will be accepted after the fixed closing dates.
5. Agency and Client will be liable for full payment of advertising booked in the event of any cancellations made within a week (5 working days) of print deadline.
6. The Client forfeits any preferential contract rates in the event of premature termination of the contract.
7. Ride Magazine does not guarantee any results in respect of advertisements inserted in the magazine.
8. Ride Magazine reserves the right to increase the rates at any time.
9. When new rates are announced, the previous rates will apply to any advance bookings for a period of 60 days after the date of announcement, after which the advertiser will be liable for the new rate unless a minimum of six (6) weeks' written notice is provided to cancel the aforementioned advance bookings.
10. The advertiser will be liable for all damages and costs that may arise from any action, which may be instituted against Ride Magazine as a result of the publication of an advertisement.
11. Advertisers are quoted and invoiced at rates determined by the number of pages booked. If, however, the advertiser subsequently changes (reduce) the number of bookings, the price will be adjusted accordingly and the advertiser will be liable for any shortfall on advertisements already placed. The shortfall will be payable immediately on invoice. Future bookings will be invoiced at the amended rate.
12. Accounts will be rendered monthly and are payable within 30 days from date of invoice.
13. Interest on arrears shall be payable at maximum rates as determined in ACT 73 of 1968.
14. In the event of any payment not being made by the Advertiser on/or before the due date, the full balance outstanding will immediately become due, owing and payable.
15. The advertiser consents to the jurisdiction of the Magistrate's Court, notwithstanding the possibility that any amount claimed could fall outside the jurisdiction of the Magistrate's Court, and further undertakes to pay all legal expenses incurred, including cost on an attorney-client scale, collection charges and tracing fees, in the recovery of all amounts due to Ride Magazine.
16. The advertiser undertakes to notify Ride Magazine in writing within 7 (seven) days of any change of address.
17. The advertiser undertakes, notwithstanding any sale of its business, and/or change of its members, to accept the liability of settling its debt to Ride Magazine in full.
18. The advertiser warrants the authority of the signatory to this Agreement and warrants the correctness of the information in this application.
19. The street address as mentioned on the order form, has been chosen as domicilium citandi et executandi for any purpose, action or payment as far as the application is concerned.
20. Print orders are estimates only and Ride Magazine reserves the right to adjust print orders.
21. Ride Magazine does not guarantee advertisement placement requests and reserves the right to place advertising on any page of the issue, unless a guaranteed special position is booked and paid.
